Privacy Policy

Last updated: October 29, 2026

Swell is a product of Cristian Horta Consulting, a sole proprietorship in San Diego, California.

This policy explains what Swell collects when businesses ("Operators") use it to talk with their customers ("End Users," "you"), and what we do with it. It is part of our Terms of Service.

1. Data We Collect

When you use the Swell widget, call or text a business through Swell, or message a business's Facebook Page or Instagram account where it uses Swell, we may collect:

  • Your name, email address, phone number, and service address (only what you provide)
  • Job description and photos you submit
  • Chat conversations, text message threads, Facebook Messenger and Instagram conversations with the business, call transcripts, and AI-generated summaries of them
  • Your phone number from caller ID when you call
  • If you message the business on Facebook or Instagram: the name on your profile, and the ID Meta assigns to your conversation with that business
  • Appointment details, if you book or reschedule an appointment
  • Basic usage data (page URL where the widget is embedded)

If you run a Swell account (an Operator), we also collect your name, email address, phone number, business details, and billing information. Payments are processed by Stripe; Swell never receives your full card number.

We do not sell your personal information to third parties.

2. How We Use Your Data

  • To facilitate your quote request with the business
  • To generate AI responses, call summaries, and message drafts on the business's behalf
  • To send SMS notifications about your request (with your consent)
  • To monitor and improve the accuracy, safety, and performance of the AI assistant. For this, we keep limited logs of AI interactions with phone numbers, email addresses, and street numbers removed, and delete them automatically after 60 days.
  • To comply with legal obligations

No model training: Swell does not use your conversations, calls, or photos to train AI models. Our AI model provider, Anthropic, processes them under commercial terms that do not allow it to train its models on that data.

3. Data Sharing

Your information is shared with:

  • The Operator (the business you are contacting). They receive your quote request details, conversations, photos, and call transcripts and summaries.
  • Anthropic, our AI model provider, which generates the assistant's responses. Anthropic does not train its models on this data and keeps it only for a limited period under its commercial terms.
  • Twilio, our phone and text messaging provider. During calls, Twilio uses Deepgram to transcribe your speech and Google or ElevenLabs to voice the assistant's replies. The voice providers receive only the assistant's text, not your voice.
  • Meta, if the business connects its Facebook Page or Instagram account. Your messages arrive through Meta, and replies to you are sent back through it (see Facebook Messenger & Instagram).
  • Google, if the business connects Google Calendar. Appointment details are added to its calendar (see Google API Services & Calendar Integration).
  • Calendly, if the business connects it for scheduling. An appointment you book through its link is created in the business's Calendly account.
  • Railway and Resend, which host our servers and deliver our email
  • Stripe, which processes Operators' subscription payments

When an Operator signs up, we estimate their country from their IP address using a database stored on our own servers, so the address isn’t sent to anyone. This site or product includes IP2Location LITE data available from https://lite.ip2location.com.

4. Google API Services & Calendar Integration

Swell offers integration with Google Calendar to allow Operators to automatically schedule appointments.

  • Data Access: When an Operator connects their Google Calendar, Swell requests read and write access to their calendar events to check availability and create new appointments.
  • Data Use: Google Calendar data is used strictly to provide the scheduling features within the Swell application. It is not used for any other purpose.
  • Data Storage: We do not store your calendar events in our database. We only store the OAuth authentication tokens necessary to communicate with Google APIs on your behalf. These tokens are protected as described under Data Protection & Security.
  • Limited Use Policy: Swell's use and transfer to any other app of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.
  • AI/ML Models: Data obtained through Google Workspace APIs is never used to develop, improve, or train generalized Artificial Intelligence (AI) or Machine Learning (ML) models.

5. Facebook Messenger & Instagram

An Operator can connect its Facebook Page or Instagram professional account to Swell. Swell then receives the messages customers send to that Page or account, through Meta's official APIs, so its assistant can reply and the business can answer from Swell.

  • What we receive: the text and photos of messages sent to the connected Page or account, the name on the sender's profile, and the ID Meta assigns to each conversation with that business, which is how replies reach the right person.
  • How we use it: only to run that business's conversations: the assistant's replies, the request summary the business sees, and the replies the business sends from Swell.
  • What we don't do: we don't sell this data, use it for advertising, or use it to train AI models, and we share it only with the business and the providers listed under Data Sharing that process it on our behalf.
  • No texts: someone who reaches a business through Messenger or Instagram is not sent text messages. Replies go back in the same conversation.
  • How long we keep it: messages and photos stay with the business's requests for as long as described under Data Retention, and are deleted on request (see Deleting Your Data). Access tokens are deleted as soon as the Page or account is disconnected.
  • Disconnecting: an Operator can disconnect its Page or account in Swell's Settings at any time, and Swell deletes the stored Meta access tokens right away. Removing Swell from your Facebook or Instagram settings does the same.

To delete data Swell received from Facebook or Instagram, see Deleting your data.

6. Data Protection & Security

We take care to keep your data secure and confidential, including Google user data, Meta platform data, and the access tokens Swell uses on an Operator's behalf:

  • Encryption in Transit: All data transmitted between your browser, our servers, and third-party services (such as Google and Meta APIs) is encrypted using industry-standard HTTPS/TLS.
  • Stored Securely: Conversations, photos, and the tokens Swell uses to reach Google, Calendly, Facebook, and Instagram are stored on our hosting provider's servers and are never publicly accessible. Facebook and Instagram access tokens are also encrypted at rest.
  • Access Controls: Access to Operator and End User data is limited to authorized personnel and the automated systems that need it to run the Service.
  • Disconnecting Integrations: An Operator can disconnect any integration in Swell's Settings at any time, which deletes its stored tokens from Swell. To withdraw Swell's access on the provider's side too, remove Swell in that provider's account settings (for example, your Google Account's third-party access page).

7. Data Retention

Quote requests, conversations, and photos, including messages and photos received through Facebook or Instagram, are kept while the Operator's account is active. An Operator can delete a request from its dashboard, which removes the request and its conversation from Swell. Photos are deleted when you or the Operator ask us to delete your data, and when the Operator's account is deleted. You may request deletion of your data at any time (see Deleting Your Data).

Logs used to monitor AI quality are deleted after 60 days (see How We Use Your Data).

8. Deleting Your Data

  • If you contacted a business through Swell: ask that business, or email support@askswell.com with the business's name and the phone number, email, or Facebook or Instagram name you used. We'll delete your messages, photos, and contact details from Swell and confirm by email.
  • If you run a Swell account: delete individual requests in your dashboard, disconnect integrations in Settings, or email us to delete your account and everything in it, including uploaded photos.
  • Facebook and Instagram: see Deleting your data for connections and data received from Meta.

We may keep a record that a deletion happened, and anything the law requires us to keep, such as billing records.

9. Cookies & Tracking

The Swell widget uses sessionStorage (not cookies) to preserve your chat history within a single browser session. This data is never transmitted to third parties and is cleared when you close the browser tab.

Our own website, askswell.com, uses Google Analytics, which sets cookies to count visits and see how the site is used, including chats started on it. The chat widget on a business's own website doesn't report anything to Swell's Google Analytics.
